By accessing or using the NexGen QA platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
NexGen QA provides an AI-powered software quality assurance platform that includes automated testing, security scanning, accessibility auditing, performance analysis, and related services. The Service is provided "as is" and may be updated from time to time.
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access. You are responsible for all activities that occur under your account. Accounts with multi-factor authentication (MFA) enabled receive enhanced protection.
You agree not to: use the Service to test systems you do not own or have authorization to test; attempt to bypass authentication, rate limiting, or security controls; use the AI features to generate harmful, misleading, or illegal content; share account credentials or API keys with unauthorized parties; exceed the usage limits of your subscription plan.
You retain all rights to your test cases, test data, and scan results. NexGen QA retains all rights to the platform, AI models, and underlying technology. We do not claim ownership of any content you create using the Service.
Paid plans are billed monthly or annually. Trial periods are 14 days. Cancellation takes effect at the end of the current billing period. Refunds are provided on a case-by-case basis within 30 days of purchase. Usage limits reset at the start of each billing cycle.
We target 99.9% uptime for the platform. Scheduled maintenance windows are communicated 48 hours in advance. Unplanned outages are addressed with priority based on severity. Enterprise and Government plans include dedicated SLA commitments.
To the maximum extent permitted by law, NexGen QA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.
Either party may terminate this agreement with 30 days written notice. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, you may export your data within 30 days. After 30 days, we will delete your data in accordance with our retention policy.
